1. Acceptance of Terms
Use of this Web site is
conditioned on the acceptance, without modification, of
all terms and conditions of this agreement. By using this
Web site you represent that you have read and understand
the terms and conditions and that you agree to be bound by
these terms and conditions as set forth below.
CURRENT JOBS FOR GRADUATES ("CJG") reserves the right at
its discretion to modify the terms and conditions under
which this Web site is offered. Use of this Web site after
the posting of any such modification constitutes your
agreement to be bound by the terms and conditions as
modified.
2. Definitions
(a) "BULLETINS" means
the Internet or emailed versions of any of the eight
publications listed below.

CJG reserves the right to
add or delete BULLETINS content at any time.
(d) "Subscriber" means a
single individual or a non-profit educational institution
or a member of a consortium of such institutions that has
remitted the appropriate subscription fee to CJG.
(c) "Authorized User" means the subscriber himself or an
employee, faculty member, staff member, or student
officially and currently affiliated with the Subscriber,
or, in the case of a school account, an alumnus of the
Subscriber within 1 year of graduation. The
Subscriber shall be responsible for verifying the status
of Authorized Users.
3. Scope of License
The subscription includes
authorization of access to BULLETINS by means of a User ID
and password for Authorized Users via multiple connections
or receipt of BULLETINS via email.
This subscription entitles
the authorized users to access the BULLETINS to:
(a) make searches of the
BULLETINS,
(b) make one or more print
copies of the output of any search; such copies may not be
sold and may not be distributed to anyone who is not an
Authorized User; and
(c) download search
results to hard disk or diskette, provided that such data
are not made available to anyone who is not an Authorized
User.
(d) repost BULLETINS copy on its educational website,
provided that viewing of such web page is restricted to
only other Authorized Users.
An Authorized User may not
make the BULLETINS available to anyone other than another
Authorized User, whether by telephone link or by
permitting access through his or her terminal or computer;
or by other similar or dissimilar means or arrangements.
University/college or
corporate accounts are intended for a single department or
office and its direct users, not for an entire
campus. The account holder may distribute its ID and
password to its direct users in a discreet manner, but may
not openly post the access information on its public
website, not distribute the information to other
departments or offices. Use of a single
university/college departmental subscription is intended
for use by its current students or alumni within 1 year of
graduation, but not for alumni who have graduated more
than 1 year ago.
The Subscriber is solely
responsible for all security, and all use (including
unauthorized use) of the BULLETINS provided to its
Authorized Users, and will undertake reasonable and
appropriate methods to enforce the terms of access.
Enforcement must not violate the privacy and
confidentiality of Authorized Users.
The Subscriber may not
utilize the BULLETINS for commercial purposes, including,
but not limited to the sale of materials, fee-for-service
use of the Bulletins, or bulk reproduction or distribution
of materials in any form; nor may the Subscriber impose
special charges on Authorized Users for use of the
Bulletins. Furthermore, under no circumstances may the
Subscriber (a) remove, obscure, or modify any copyright or
other notices included in the materials; or (b) use
materials in a manner that would infringe the copyright
therein.
The Subscriber shall use
reasonable efforts to protect the BULLETINS from any use
that is not permitted under this Agreement, and shall
notify CJG of any such use of which it learns or is
notified. In the event of violation of the User Rules, the
Subscriber agrees to consider the imposition of further
restrictions on access to, and downloading and printing
from, the BULLETINS.
The Subscriber understands that Internet
browser software is required to access the BULLETINS
online, and a valid email address is required to receive
the BULLETINS via email.
4. Terms and Fees
A new subscription will
become effective on the day of receipt and processing of a
subscription order and the issuance of an ID and password
to the Subscriber. The length of the subscription
may be one year or on a month-to-month basis, as
determined by the Subscriber. The subscription will
remain in effect thereafter so long as subscription fees
are paid.
The Subscriber shall be
responsible for all costs associated with establishing
access to the BULLETINS including but not limited to any
telecommunications or other charges imposed by carriers,
proprietary network operators and Internet access
providers, or licenses for browser software, if any. The
Subscriber shall also be responsible for all costs
associated with printing from the BULLETINS, and for any
taxes relating to the Subscriber's or authorized Users'
use of the BULLETINS.
Subscription fees are
non-refundable.
5. Copyright
All material ("Materials")
displayed or transmitted on this site, including but not
limited to text, photographs, images, illustrations, video
clips, audio clips, and graphics are owned by Current
Jobs, or have been licensed by their individual owners,
and are protected by United States and international
copyright, trademarks, service marks, and other
proprietary rights, laws and treaties.
The subscriber acknowledges that it has no
claim to ownership by reason of its use of or access to
the BULLETINS.
6. Suspension or Termination
of Access
In the event of a material breach of this
Agreement by the Subscriber, which breach is not cured
within 30 days notice by CJG that such breach has
occurred, the Subscriber shall immediately cease using
the product and Subscriber's access to the BULLETINS
shall terminate.
7. Representations and
Warranties
(a) While CJG makes every
effort to only list jobs which are bonafide vacancies with
clearly labeled, valid employers, we are not responsible
for the accuracy of the job information, the length of the
time the vacancy will be available, the contact
information for the jobs, and any consequences to our
users that may follow from them applying to given jobs
listed on the CJG website. The inclusion of links on this
site does not constitute an endorsement of the employer or
a guarantee that a job even exists with a given employer.
CJG assumes no liability whatsoever for the quality or
legality of the jobs posted on its site, or whether or not
employers are actually able to hire a candidate in
response to a given job listing. Listed jobs may be filled
or cancelled at any time at an employer's
discretion.
(b) CJG has made and will
make good faith efforts to ensure that the BULLETINS are
complete and accurate. However, the CJG does not warrant
completeness or accuracy, and does not warrant that the
Subscriber's use of the BULLETINS will be uninterrupted or
error-free, or that the results obtained will be useful or
will satisfy the user's requirements.
(c) CJG warrants that it
is entitled to grant the licenses outlined in this
agreement, but makes no other warranties or
representations of any kind, expressed or implied,
including but not limited to warranties of merchantability
or fitness for a particular purpose.
(d) The subscriber will be
permitted to access the BULLETINS at any time. The CJG
will not be liable for any delay, down time, or other
failure of performance, but will use reasonable efforts to
correct any performance problem brought to its attention.
(e) CJG will not be
responsible for incidental, consequential, or any other
damages arising out of or in connection with the service
or materials provided hereunder.
(f) CJG makes no
warranties respecting any harm that may be caused by the
transmission of a computer virus, worm, time bomb, logic
bomb, or other such computer program. CJG further
expressly disclaims any warranty or representation to
Authorized Users, or to any third party.
(g) The Subscriber shall
be responsible for all claims, costs, demands, expenses,
and liabilities, including reasonable attorney's fees,
resulting from: (i) breach of this Agreement by the
Subscriber; and (ii) the Subscriber's negligent use of the
BULLETINS, if directed by a Court of Law.
(h) The BULLETINS are
provided on an "as is" basis, and CJG disclaims any and
all other warranties, conditions, or representations
(express, implied, oral, or written), relating to the
BULLETINS or any part thereof, including, without
limitation, any and all implied warranties of quality,
performance, compatibility, merchantability or fitness for
a particular purpose.
(i) CJG does not knowingly
place advertisements that discriminate or that are not
bonafide vacancies. Positions are compiled from a variety
of sources including vacancy announcements provided to the
publisher, and other published sources. Please note that
many employers do not acknowledge application for their
vacancies.
(j) This disclaimer of
liability applies to any damages or injury caused by any
failure of performance, error, omission, interruption,
deletion, defect, delay in operation or transmission,
computer vius, act of God/act of nature, communication
line failure, theft or destruction or unauthorized access
to, alteration of, or use of record, whether for breach of
contract, tortious behavior, negligence, or under any
other cause of action.
